1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

• "Verdanthill", "we", "us", "our" — refers to the Verdanthill home care service, operated from No. 136, Section 4, Zhongxiao East Road, Zhonghe District, New Taipei City 235, Taiwan.
• "Service" — refers to any in-home elderly care program provided by Verdanthill, including Weekend Respite Care, Nighttime Monitoring, and Premium Holistic Home Care.
• "Client" — refers to the individual or family entering into a service arrangement with Verdanthill.
• "Care Recipient" — refers to the elderly individual receiving care.
• "Agreement" — refers to the care arrangement confirmed in writing between Verdanthill and the Client.

2. Acceptance of Terms

By engaging our services or submitting an enquiry through our website, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into a service agreement
• You accept these Terms and Conditions in full
• Where applicable, you are acting on behalf of the Care Recipient with appropriate authority

3. Service Description

Verdanthill provides professional in-home care services for elderly individuals in New Taipei City. Services are delivered as set out in the written care plan agreed with each Client. Verdanthill reserves the right to decline or end a service arrangement where it determines that the requested care exceeds the scope of home-based services or poses an unacceptable risk.

Services are currently available primarily in Zhonghe District and surrounding areas of New Taipei City. Geographic availability may vary.

4. Service Arrangements and Scheduling

• Service arrangements are confirmed in writing following an initial consultation and care assessment
• Clients are requested to provide a minimum of 48 hours' notice for scheduling changes where possible
• Verdanthill will make reasonable efforts to maintain caregiver consistency but cannot guarantee the same caregiver in all circumstances
• In the event of caregiver unavailability, Verdanthill will arrange qualified backup coverage and notify the Client promptly

5. Client Responsibilities

• Providing accurate information about the Care Recipient's health status, routines, and needs
• Notifying Verdanthill of any relevant changes to the Care Recipient's condition or situation
• Ensuring that the care environment is reasonably safe and accessible for the caregiver
• Treating Verdanthill caregivers and staff with respect and in a manner consistent with applicable laws
• Not requesting caregivers to perform tasks outside the scope of the agreed care plan without prior discussion

6. Payment Terms

• Service pricing is provided in New Taiwan Dollar (NT$) and confirmed in writing prior to service commencement
• Program base prices are: Weekend Respite Care from NT$8,300; Nighttime Monitoring from NT$16,200; Premium Holistic Home Care from NT$60,400
• Final pricing is agreed individually and reflected in the written service arrangement
• Payment terms and accepted payment methods are specified in the service agreement
• All prices are subject to change with reasonable advance notice for existing arrangements

7. Cancellation and Refund Policy

• Clients may cancel a scheduled session with a minimum of 24 hours' notice without charge
• Cancellations made with less than 24 hours' notice may be subject to a short-notice fee as specified in the service agreement
• Ongoing arrangements may be terminated by either party with written notice as specified in the service agreement
• Refunds for prepaid amounts are processed in accordance with the terms set out in the individual service agreement

8. Intellectual Property

All content on the Verdanthill website, including text, design, and branding, is the property of Verdanthill and may not be reproduced or used without our written permission. Clients are granted a limited, non-exclusive right to access the website for personal, non-commercial purposes.

9. Disclaimers

Verdanthill provides professional home care assistance. Our services do not constitute medical treatment, and caregivers are not licensed medical practitioners. We do not make representations regarding specific health outcomes.

10. Limitation of Liability

To the extent permitted by applicable Taiwan law, Verdanthill's liability for any claim arising from the delivery of services is limited to the amount paid for the specific service session in question. Verdanthill is not liable for indirect, consequential, or incidental losses.

Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

11. Confidentiality

Verdanthill treats all information relating to Clients and Care Recipients as confidential. Caregivers and staff are required to maintain confidentiality as a condition of their engagement. For full details of how personal data is handled, please see our Privacy Policy.

12. Termination

• Either party may terminate the service arrangement with written notice as specified in the individual agreement
• Verdanthill may terminate immediately where there is a serious safety concern for caregivers or the Care Recipient
• On termination, any outstanding payments become due immediately

13. Dispute Resolution

In the event of a dispute, the parties agree to first attempt resolution through direct, good-faith communication. If this is unsuccessful, disputes will be subject to the jurisdiction of the courts of New Taipei City, Taiwan, and governed by the laws of the Republic of China (Taiwan).

14. General Provisions

• These Terms constitute the entire agreement between Verdanthill and the Client, alongside the written service agreement
• If any provision is found to be unenforceable, the remaining provisions remain in full effect
• Failure to enforce any provision does not constitute a waiver of that right
• Verdanthill may update these Terms from time to time; the current version will always be available on our website
